The Workers’ Compensation Board (WCB) of Nova Scotia has approved a new policy governing reviews of the extended earnings replacement benefit (EERB), following a public consultation that ran from Feb. 13 to March 16, 2026.

The board of directors approved the policy after the consultation period closed. WCB says this concludes policy development on the EERB review.

The policy change follows an amendment to the Workers’ Compensation Act made in fall 2025. Bill 144 changed the law to allow WCB to review an EERB at any time, rather than only at fixed intervals of 36 and 60 months. That change took effect Jan. 1, 2026.

The new policy was developed to support implementation of that legislative change.

Consultation process

During the consultation period, WCB invited feedback through two channels. Stakeholders could attend one of two online policy webinars held March 2 and March 4, 2026, or submit written comments by email or mail to WCB’s policy department in Dartmouth, N.S.
