WSCC Lay Charges under the Northwest Territories Safety Act and Mine Health and Safety Act

Yellowknife, NT (September 26, 2023) – On August 25, 2023, the Workers’ Safety and Compensation Commission (WSCC) filed seven charges against SMS Equipment Inc. in the Northwest Territories’ Territorial Court under both the Safety Act and the Mine Health and Safety Act.

SMS Equipment is charged with multiple counts alleging violations of the Safety Act and the Mine Health and Safety Act, including failure to maintain their establishment such that the safety of their employees was not likely to be endangered, and that it failed to take every reasonable measure to protect the health and safety of their employees, as well as other offences.

The charges were filed following an investigation by WSCC Safety Officers in relation to an incident that occurred on September 1, 2022, at the Gahcho Kué Mine Maintenance Shop that resulted in the death of a worker.

The first court appearance is scheduled for October 24, 2023, in Yellowknife, Northwest Territories.

As the matter is now before the courts, WSCC is not able to provide further information or comment at this time.
